Katotam Tahkiminde Dosyanın Hakemlere Tevdii Süreci

Tahkim süreci, tahkim davasının açılmasıyla başlamakta, tahkim yargılamasının sonunda verilen hakem kararının kesinleşmesiyle sona ermektedir. Kurumsal tahkimde, tahkim davası açıldıktan sonra, sekretarya bir taraftan tahkim giderleri ve hakem ücretlerinin tahsili ile ilgili iş ve işlemleri gerçekleştirirken, diğer taraftan da tahkim merkezinin kuralları çerçevesinde hakem seçimi ve ataması ile ilgili işlemlerin gerçekleştirilmesini sağlamaktadır. Tahkim merkezi, uyuşmazlığın esası ile ilgili olarak herhangi bir karar vermemekte, uyuşmazlıkla ilgili kararı, tahkim merkezince atanan hakem ya da hakem kurulu vermektedir. KATOTAM tahkiminde tahkim yargılamasını yürütecek hakemler, Merkez Yönergesindeki tahkime ilişkin kurallar çerçevesinde taraflar ve/veya Merkezin Divan Kurulu tarafından seçilmektedir. Hakem seçimine ilişkin işlemlerin kesinleşmesinden, avans niteliğindeki tahkim giderleri ve hakem ücretlerinin ödenmesinden sonra da, tahkim dosyası hakemlere tevdii edilmektedir. Tahkimin başarısı, hakemlerin başarısına bağlıdır. Dolayısıyla hakem olarak görevlendirilecek kişilerin uzmanlık alanı ve zaman açısından uygun kişiler olması gerekir. Yine, adil, objektif, tarafsız bir hakem kararı verilebilmesi için hakemlerin bağımsızlık ve tarafsızlıklarının sağlanması da zorunludur.

The arbitration process begins with the filing of the
arbitration case and ends with the finalization of the decisions to
terminate the arbitration proceedings. In institutional arbitration,
after the arbitration case is filed, the secretariat carries out the
works and transactions related to the collection of arbitration
expenses and arbitrator fees, on the one hand; on the other hand,
ensures that the procedures related to the selection and appointment
of arbitrators are carried out within the framework of the rules of
the arbitration center. The arbitration center does not make any
decision on the merits of the dispute, but the arbitrator or arbitral
tribunal appointed by the arbitration center makes the decision on
the dispute.
The arbitrators who will conduct the arbitration proceedings
in KATOTAM arbitration are selected by the parties and/
or the Court Board of the Center within the framework of the
arbitration rules in the Central Directive. After the finalization
of the procedures regarding the selection of arbitrators and the
payment of advance arbitration expenses and arbitrator fees, the
arbitration file is transmitted to the arbitrators. The success of
arbitration depends on the success of the arbitrators. Therefore, the
persons to be appointed as arbitrators should be suitable people in
terms of expertise and time. Again, it is obligatory to ensure the
independence and impartiality of the arbitrators in order to give a
fair, objective and impartial arbitral decision.
